These Terms & Conditions (“Terms”) govern your access to and use of the website mjsigne.com and any content, products, or services offered through it (collectively, the “Site”), operated by Aether & Ink, LLC (“Company,” “we,” “us,” or “our”), which publishes creative works under the pen name “MJ Signe.” By accessing or using the Site, or by purchasing a product, you agree to be bound by these Terms. If you do not agree, do not use the Site.

I. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase products. By using the Site you represent that you meet this requirement and that the information you provide is accurate.

II. The Pen Name “MJ Signe”
“MJ Signe” is a pen name (nom de plume) used by Aether & Ink, LLC. References to MJ Signe refer to works published by the Company. The pen name, associated logos, and branding are the property of the Company and may not be used without our written permission.

III. Intellectual Property
All content on the Site, including but not limited to books, stories, articles, blog posts, text, artwork, cover designs, graphics, logos, and the selection and arrangement of that content, is owned by or licensed to the Company and is protected by copyright, trademark, and other intellectual property laws.

Except as expressly permitted, you may not: Copy, reproduce, distribute, publicly display, or create derivative works from our content;

Reproduce, scan, upload, or share our books or other works without authorization;

Use our content to train, develop, or improve any machine-learning or artificial-intelligence model without our prior written consent;

Use our trademarks, pen name, or branding in a way that suggests endorsement or affiliation.
You may view and enjoy content for your personal, non-commercial use, and share ordinary links to the Site.

IV. Purchases, Pricing, and Payment
In the event we offer physical and/or digital products for sale (such as books, e-books, and related merchandise). By placing an order you agree to pay the listed price plus any applicable taxes and shipping. Prices, availability, and product descriptions may change at any time and may contain errors; we reserve the right to correct errors and to refuse or cancel any order, including after an order is placed.

Payments are processed by a third-party payment processor (e.g., Stripe, PayPal). By purchasing, you agree to that processor’s terms, and you represent that you are authorized to use the payment method provided.

V. Digital Products and License
When you buy a digital product (such as an e-book), we grant you a limited, non-exclusive, non-transferable, revocable license to download and use it for your personal, non-commercial use. You do not acquire ownership of the underlying work. You may not resell, sublicense, distribute, or remove any copyright or watermark from digital products.

VI. Shipping and Delivery
For physical products, we will provide estimated shipping timelines at checkout. Delivery dates are estimates, not guarantees, and risk of loss passes to you upon delivery to the carrier. Digital products are delivered electronically, typically via a download link or email after payment is confirmed.

VII. Returns, Refunds, and Cancellations

Physical products: no returns except for defects. Because of our limited inventory and custom bulk orders, all sales of physical products are final, and we do not offer returns or refunds unless the product is damaged due to a production and/or shipping error. If your product arrives damaged (for example, unintentional discoloration, tears, rips, stains, or cracks), you may choose either a replacement or, if you prefer not to receive a replacement, a refund. To be eligible, you must contact us within 10 days of delivery and, if requested, provide photographs showing the damage.

Third-party merchandise and “not as described” items. Certain physical merchandise (for example, t-shirts, sweatshirts, hoodies, and hats) is designed, marketed, and produced by a third-party company. We cannot guarantee that these items will be an exact match to the color and/or description offered by the third-party company. For that reason, no refunds or replacements are available for items claimed to be “not as described,” unless the wrong item was sent to you.

Requesting a replacement or refund. To dispute an order and request a replacement or refund, send a request to hello@mjsigne.com. We evaluate each dispute individually and will work in good faith to settle it.

Digital products. Because digital products are delivered immediately and cannot be returned, all sales of digital products are final, except where required by law or where the file is defective. To request a refund or report a problem with a digital product, contact us at hello@mjsigne.com.

VIII. Newsletter and Communications
By subscribing to our newsletter, you consent to receive emails from us, including updates and marketing messages. You may unsubscribe at any time using the link in any marketing email. Your subscription is also governed by our Privacy Policy.

IX. User Conduct
When using the Site, you agree not to:

Violate any law or the rights of others;

Interfere with or disrupt the Site, its security, or its servers;

Attempt to gain unauthorized access to any part of the Site or its systems;

Use automated tools to scrape, harvest, or collect content or data except as expressly permitted;

Submit content that is unlawful, infringing, defamatory, harassing, or otherwise objectionable.

X. User-Submitted Content
If you submit reviews, comments, or other content to the Site, you grant the Company a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content in connection with the Site and our business. You represent that you own or have the rights to any content you submit. We may remove any submitted content at our discretion.

XI. Third-Party Links and Affiliates
The Site may contain links to third-party websites and affiliate links. We are not responsible for the content, products, or practices of third parties. If you purchase through an affiliate link, we may earn a commission at no additional cost to you.

XII. Disclaimers
The Site and all content and products are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Any creative works are works of the imagination and are provided for enjoyment; nothing on the Site is professional, legal, medical, or financial advice.

XIII. Limitation of Liability
To the fullest extent permitted by law, the Company and its owners, members, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Site or products. Our total liability for any claim relating to the Site or a product will not exceed the greater of the amount you paid us for the product giving rise to the claim or [USD amount, e.g., $100].

XIV. Indemnification
You agree to indemnify and hold harmless the Company and its owners, members, and affiliates from any claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your infringement of any rights of a third party.

XV. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Wyoming, where Aether & Ink, LLC is organized, without regard to its conflict-of-laws rules.

Mandatory, step-by-step dispute resolution. Except for the limited matters described in the “Exceptions” subsection below, you and the Company agree that any dispute, claim, or controversy arising out of or relating to the Site, a purchase, or these Terms (a “Dispute”) must proceed through the following steps, in this order. Neither party may commence litigation over a Dispute until Steps 1 through 3 have been completed. Completing informal resolution and mediation is a mandatory precondition to arbitration, and completing arbitration is a mandatory precondition to any lawsuit.
a. Step 1: Informal Resolution
The party raising a Dispute will first send the other party a written notice describing the Dispute and the relief sought, using the contact information in Section 18. The parties will then attempt in good faith to resolve the Dispute informally within thirty (30) days after that notice is sent.

Notice of a Dispute to the Company must be sent in writing to the address below (a “Notice of Dispute”). Your Notice of Dispute must include your name, the email address associated with any order or subscription, a description of the Dispute, and the specific relief you seek:

b. Step 2: Mediation
If the Dispute is not resolved within that thirty (30)-day period, the parties agree to submit the Dispute to confidential, non-binding mediation before proceeding to arbitration. The mediation will be administered by the American Arbitration Association (AAA) under its Commercial or Consumer Mediation Procedures (as applicable) before a single, mutually agreed mediator, and will take place in Sheridan County, Wyoming, or by videoconference. The parties will share the mediator’s fees equally and each bear their own other costs. Mediation is a required precondition to arbitration.

c. Step 3: Binding Arbitration
If the Dispute is not resolved by mediation within sixty (60) days after the request for mediation (or a longer period the parties agree to in writing), the Dispute will be finally resolved by binding arbitration before it may be brought to court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or Commercial Arbitration Rules, as applicable) under its then-current rules, before a single arbitrator, seated in Sheridan County, Wyoming, and may be conducted by videoconference. The arbitrator’s decision will be final and binding, and judgment on the award may be entered in any court of competent jurisdiction. Each party will bear its own costs except as the arbitrator or the applicable rules provide.
d. Exception: When Court Is Permitted
Litigation over a Dispute is permitted only after Steps 1 through 3 have been completed, and then solely to confirm, enforce, vacate, or modify the arbitration award. Notwithstanding the steps above, either party may, without first completing them, (a) bring an individual claim in small-claims court if the claim qualifies, and (b) seek temporary or preliminary injunctive or other equitable relief in the state or federal courts located in Sheridan County, Wyoming to protect intellectual property or confidential information pending completion of mediation and arbitration. For those limited purposes, the parties consent to the personal jurisdiction and venue of those courts.
e. Class-Action and Jury Waiver
To the fullest extent permitted by law, Disputes will be resolved only on an individual basis. You and the Company each waive any right to participate in a class, collective, consolidated, or representative action and any right to a jury trial.

XVI. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

XVII. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Site and supersede any prior agreements.
